These General Terms and Conditions govern the use of www.billybrussels.com and all purchases made through the website.

Billy is the trading name of Tatiana André-Dumont, a sole trader established in Belgium.

By accessing the website or placing an order, you agree to these General Terms and Conditions. Nothing in these terms limits any mandatory rights granted to consumers under applicable Belgian or European Union law.

These terms apply to orders placed through www.billybrussels.com by customers located in the countries to which Billy currently delivers: Belgium, France, Luxembourg and the Netherlands.

The version available on the website at the time an order is placed applies to that order.

To place an order, you must be at least 18 years old or otherwise have the legal capacity and authorisation necessary to enter into a binding contract.

You must provide accurate, complete and current information when placing an order.

Billy makes reasonable efforts to describe and display each product accurately, including its main characteristics, materials, colours and sizing.

Colours and details may appear slightly different depending on the device, screen settings, lighting or natural characteristics of the fabric. These minor variations do not affect your statutory rights where a product does not conform to the contract.

Measurements and size guidance are provided as an indication. Customers are encouraged to consult the Size Guide before ordering.

Products are offered subject to availability. Billy produces in limited quantities, and placing an item in your cart does not reserve it.

If a product becomes unavailable after an order has been placed, we will inform you as soon as possible and refund the affected amount using the original payment method.

Prices are displayed in euros and include Belgian VAT where applicable.

Delivery charges and any available discounts are shown before the order is submitted. The total amount payable is displayed at checkout.

Billy may change prices at any time. A price change does not affect an order that has already been confirmed, except where an obvious pricing or technical error has occurred and the order cannot reasonably be fulfilled at the incorrect price.

Before submitting an order, you can review and correct the contents of your cart, delivery information and selected payment method.

By clicking the final payment button, you place an order with an obligation to pay.

After payment has been authorised, you will receive an order confirmation by email. The sales contract is formed when the order is confirmed.

Billy reserves the right to cancel or refuse an order for legitimate reasons, including:

• product unavailability;
• an obvious pricing or product-information error;
• suspected fraud or unauthorised payment;
• incorrect or incomplete customer information;
• inability to deliver to the address provided.

If payment has already been received for a cancelled order, the corresponding amount will be refunded.

Available payment methods are displayed at checkout and may include payment cards, Bancontact, PayPal, Klarna or other methods provided through Shopify.

Payments are processed securely by independent payment providers. Billy does not directly receive or store full payment-card details.

The order will be processed only after payment has been authorised. Additional conditions imposed by a payment provider may apply to the use of its services.

Promotional codes must be entered at checkout before payment and cannot normally be applied retrospectively.

Unless expressly stated otherwise, promotional codes:

• cannot be exchanged for cash;
• cannot be combined with other offers;
• apply only during their stated validity period;
• may be limited to certain products, customers or territories.

If an order is returned, any refund will be based on the amount actually paid after the discount.

Billy currently delivers to Belgium, France, Luxembourg and the Netherlands.

Available delivery methods, prices and estimated delivery times are displayed at checkout. Delivery estimates are indicative unless a specific binding date has expressly been agreed.

Orders are delivered to the address or collection point selected by the customer. The customer is responsible for providing complete and accurate delivery information and for collecting a parcel within the carrier’s stated collection period.

Unless otherwise agreed, goods will be delivered without undue delay and no later than 30 days after conclusion of the contract.

Risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.

If you are a consumer, you have the right to withdraw from your online purchase without giving a reason within 14 calendar days from the day on which you, or a third party designated by you other than the carrier, takes physical possession of the goods.

For an order containing several goods delivered separately, the period begins when the last item is received.

To exercise this right, you must inform Billy before the 14-day period expires by sending a clear statement to contact@billybrussels.com. You may use the model withdrawal form below, but its use is not mandatory.

After notifying us, you must return the goods within 14 calendar days.

Unless the item is defective, damaged or incorrect, the direct cost of returning the goods is borne by the customer.

No restocking fee is charged.

Returned products must be handled only to the extent necessary to establish their nature, characteristics and functioning. You may be responsible for any reduction in value resulting from handling beyond what would reasonably be permitted in a physical store.

Billy will refund payments received for the returned goods, including the cost of the least expensive standard delivery method initially offered, within 14 days of being informed of the withdrawal.

We may withhold reimbursement until we have received the returned goods or until you provide evidence that they have been sent back, whichever occurs first.

The refund will be made using the original payment method unless expressly agreed otherwise.

The right of withdrawal does not apply to goods made to the customer’s specifications or clearly personalised, where the legal exception applies.

Please inspect your order after delivery and contact contact@billybrussels.com as soon as possible if an item is defective, damaged or incorrect.

Include your order number, a description of the issue and clear photographs where reasonably possible.

Where a product does not conform to the contract, the remedies and costs will be handled in accordance with the mandatory legal guarantee. The customer will not be charged return costs for an accepted defective, damaged or incorrect item.

Consumers benefit from the mandatory legal guarantee of conformity applicable to consumer goods under Belgian and European Union law.

For new goods, this guarantee applies for two years from delivery. Depending on the circumstances and legal conditions, the consumer may be entitled to repair or replacement, or, where those remedies are impossible, disproportionate or not provided within a reasonable time, to an appropriate price reduction or termination of the contract.

This legal guarantee applies independently of the commercial return policy and cannot be excluded or reduced by these terms.

If you wish to cancel or change an order before dispatch, contact contact@billybrussels.com as soon as possible.

We will try to accommodate the request, but changes or cancellations cannot be guaranteed once an order has entered preparation or has been dispatched. This does not affect the statutory right of withdrawal.

All content available on the website, including the Billy name, logos, photographs, designs, graphics, videos, product descriptions and written content, is owned by or licensed to Billy and is protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial purposes only.

No content may be copied, reproduced, distributed, modified, published, commercially exploited or used to create derivative works without prior written permission.

You must not misuse the website, interfere with its operation, attempt unauthorised access or use it for unlawful or fraudulent purposes.

The website may contain links to or integrations with third-party services. Billy is not responsible for the content, availability or independent practices of those third parties.

Use of third-party payment, delivery or platform services may also be subject to their own terms.

Billy does not exclude or limit liability where doing so would be prohibited by applicable law, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

Subject to those mandatory rules, Billy is not liable for indirect or unforeseeable losses that were not reasonably foreseeable when the contract was concluded.

Billy is not responsible for loss resulting from inaccurate information supplied by the customer, failure to collect a parcel on time, misuse of a product or failure to follow care instructions.

Billy will not be responsible for a delay or failure caused by circumstances beyond its reasonable control, including serious transport disruption, natural disasters, fire, war, governmental measures, widespread network failure, strikes or interruption affecting essential suppliers.

We will take reasonable steps to limit the effects of such an event and will contact affected customers where appropriate. Mandatory consumer rights remain unaffected.

Personal data is processed in accordance with our Privacy Policy, GDPR Compliance information and cookie settings.

Our store is hosted by Shopify, which processes certain information required to provide and secure the online-store and checkout services.

These terms and all sales concluded through the website are governed by Belgian law.

If you are a consumer residing in another European Union country, this choice of law does not deprive you of any mandatory consumer protection granted by the law of your country of residence.

Any dispute will be submitted to the courts having jurisdiction under the applicable consumer-protection rules.

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

Billy may update these terms for future use of the website and future orders. Changes do not retroactively alter orders already concluded.
